EU Commission Extending Data Protection to 2030

On 16th December 2025, the EU Commission announced the extension of the data protection in Article 95(5) of the EU Biocidal Products Regulation (EU BPR) to 31st December 2030.  

The document acknowledges that the completion of the EU Review Programme for existing biocidal active substances (specified in Article 89 of EU BPR), have suffered significant delays with the planned completion being delayed on multiple occasions.  

As a result, the data protection period for active substances still undergoing their first review has been increased by 5 years from 31 December 2025 to 31 December 2030. This extension aligns with the current estimate of the end of the EU Biocidal Active Substance Review Programme and aligns with the recent updates in data protection in GB BPR.  

 

What Does EU BPR Data Protection Extension Mean for Industry?

This means for companies who already support active substance product dossiers (data owners) in EU, they can continue to benefit from the initial data being protected, with the extension of this protection period. Any companies wanting to use the EU active substance data for their dossiers will require a Letter of Access to support their own applications.
